Most of us buy our home with the help of a mortgage. The lender (usually a Bank or Building Society) holds a security over our house. If we fail to pay the mortgage or breach the terms of the agreement with the lender, then the lender can re-possess.
Until the Mortgage Rights (Scotland) Act 2001 very little could be done to stop this.
However, property owners now can apply to the Sheriff for a delay to enable the mortgage arrears to be paid and for you to keep your house.
It is important to make an application to the Court as early as possible, and ideally shortly after you have been served with re-possession papers by the lender, which the lender needs to do before raising court proceedings.
